Divorce petition: Family Guidance Committee
The Family Guidance committee is the first step in the legal divorce procedure. Citizens cannot bring family disputes directly before the municipal courts. The Family Guidance committee must first get a no-objection certificate or a transfer letter before addressing the courts in such situations. Due to the importance of the family in society, this is seen as a vital step in their efforts to settle any disputes amicably between the husband and the wife.
The claimant must bring the following paperwork with him/her when meeting with the family advice committee:
Original marriage license or contract for Emirates
The Family Guidance Committee notifies the opposing party of the hearing date once the claimant has submitted the aforementioned documents. The husband and wife must appear before the committee in person at this stage of the procedure and cannot be represented by family members or divorce lawyers in Dubai.
The Family Guidance Committee may offer an additional day before issuing the No Objection letter or Transfer letter to submit the family case if the opposing party does not focus on the hearing date.
When such a notice is issued by the respondent, the respondent should obtain legal counsel before the hearing date and schedule an initial consultation with a divorce attorney of standing to determine the unique implications of the claim and how he should reply.
A No Objection Letter or Transfer Letter will be provided to the claimant by the Family Guidance Committee if both parties are focused and no peaceful resolution can be found. This NOC enables the claimant to initiate the divorce procedure by filing the lawsuit in court.
